IPS Manoj Ninama convicted for custodial torture in Bhuj

RAJKOT: Magisterial court of Bhuj has sentenced IPS officer Manoj Ninama to one year imprisonment and imposed a fine of Rs 1,000 in a 17-year old custodial torture case. Ninama is convicted for the offence he had committed as a DySP of Bhuj in the year 2001.

He is currently serving in intelligence bureau at Ahmedabad.

Additional judicial magistrate VD modh convicted Ninama under IPC section 323 (voluntary causing hurt) but stayed his order for a month after the request is made by Ninama’s advocate to grant the time to challenge the order in sessions court.

Mohmmad Ismail Sama had registered a private complain in 2001 in Bhuj court. As per the complain, Chaman Gaur and Pratapsinh issued a public notice in the newspaper for selling off their land and invited the objections. The complainant Mohmmad Sama issued other notice in newspaper raising objections saying that he is having rights in the land.

Sama was called in Bhuj city police station and Ninama asked him to withdraw his objections in land dealing. However, when Sama didn’t agree, he was charged under IPC section 385 and he was tortured and beaten in the police custody. On the second day Sama complaint to Bhuj court that he was tortured and beaten in custody after which court ordered medical checkup. Sama’s advocate Hemsinh Chowdhri said “court issued process order after physical injury is found in medical report and that too were fresh, the report said the injury was received in last 24 hours. Sessions court gave permission to issue the process. In subsequent years court also rejected Ninama’s discharge application.”

The chargesheet was framed in 2014 and after that the trial continued on evidence. “The other accused who was in custody at the time of offence was also witness of this torture and after hearing the arguments court convicted Ninama and sentenced,” Chwodhri said. Court also ordered Ninama to pay Rs 10,000 compensation to the complainant.
