Developer told to submit list of all 538 allottees

Haryana-RERA issues direction

The Haryana Real Estate Regulatory Authority (H-RERA), Gurugram, on Tuesday directed developer Earth Infrastructure Limited to submit the list of all 538 allottees along with their contact details so that they can be contacted to enquire the status quo of possession of flats.

The authority further issued restraining orders on the builders for not alienating the rights of the property till the matter is decided.

A show cause notice was directed to be issued to the company directors as to why a penalty of ₹50,000 should not be imposed on them for not appearing before the authority. The orders came in the wake of the association of allottees, Earth Copia Owners’ Society, appearing before the authority in a hearing. While interacting with the allottees, the authority discovered that there was no progress on construction and handing over of possession.

The project, Earth Copia, situated in Sector 112, Gurugram, was launched by the developer in 2011. The builder has collected approximately ₹300 crore from buyer or 80%-95 % of total sale consideration. Tthe builder began construction in September 2012 and The due date for completion of project as per the builder-buyer agreement was September 31, 2015. Construction has been abandoned since June 2016 and the licence issued by the DTCP also expired on April 21, 2015. Hence, the builder is not in a position to complete the project.
