HC fines family for challenging acquisition of land for substantially implemented layout

BENGALURU: Coming down heavily on petitioners belonging to a family for repeatedly challenging JP Nagar 8th phase, a layout scheme of the BDA, which was implemented substantially, the Karnataka high court has imposed a cost of Rs 50,000 upon them.
“The conduct of petitioner with regards to land acquisition appears to be reprehensible. The list of civil suits and writ petitions prima facie reflects that the petitioner and his family members, GPA holders or connected people have constantly misused the courts, high court as well subordinate courts by filing civil suits and writ petitions challenging very same land acquisition making a failing effort to block the development of the scheme by BDA ” justice Vineet Kothari noted in his order while asking family members of one S Khaleel to pay the cost.

The court further noted that statement filed by BDA clearly reflected that JP Nagar, 8th phase has been substantially implemented in as much 2229 sites, civic amenity sites, 3 parks and grounds over 217 acres 6 guntas of land out of 380 acres and 17 guntas of which possession was taken (by BDA) for developing the said scheme stands implemented and executed.

The preliminary notification for the layout scheme was issued on March 23,1988 and final notification was issued on October 19,2014. S Khaleel filed this petition in April 2014 and after his death in October 2015, his wife and children continued the litigation.
