Defamation case: Akali Dal leader records statement against Khaira

CHANDIGARH: The general secretary of women wing of Akali Dal and resident of Barnala Jaswinder Kaur recorded her preliminary statement and submitted evidence against AAP leader Sukhpal Singh Khaira in a defamation case filed against him in Chandigarh district court on Monday.
The case came up for hearing in the court of civil Judge Jaspreet Singh. Jaswinder Kaur had moved the defamation case against Sukhpal Khaira and pleaded to the court to take action against him for defaming her and calling her "characterless and blackmailer". The matter would come up for hearing on June 1 when three other witnesses would record their statements in the court.

The defamation case against Khaira is filed against a video which was released on December 11, 2017 on various platforms such as social media, YouTube, news channel in which he used derogatory, unparliamentary words. The video CD has also been made part of the petition. The accused is stated to have called the complainant as blackmailer and characterless.

Counsel for complainant Pardhuman Garg stated that the words used by Khaira were malicious & intending to harm the reputation of the complainant.

The petitioner while recording her statement also stated that she remained under depression due to defamatory words against the complainant by the accused. It was further argued that the prestige, image and reputation of the complainant has been adversely affected and this video has lowered down her image in the society and general public at large due to false imputation made by the accused with an intention to lower down the reputation and character of the complainant with malafide intention.

It was pressed upon that the sole intention of the accused was to defame, disrepute, harass and to cause wrongful loss & injury to the complainant. The complainant has suffered lost of her reputation.

She narrated that on march 5, the complainant went to Elante Mall, Chandigarh for shopping . There she met two of her very close friends namely Manpreet Kaur Hundal & Surinder Kaur and other friends. The complainant tried to meet the friends but they were looking confused & uncomfortable talking to the complainant, but somehow the complainant forcefully stopped them and asked what was the reason for ignorance. They very abruptly said that they saw the video where the accused Sukhpal Khaira alleged that "you are a blackmailer & characterless". And this was the reason they ignored the complainant. The complainant felt very embarrassed, humiliated and depressed that the accused has used such a unparliamentary language against her.
