Govt to file review petition in Apex Court

Toeing the line of the Centre, the State Government will also file a review petition in the Supreme Court against its March 20 judgement on ST/SC (Prevention of Atrocities) Act.

Chief Minister Raghubar Das has instructed the Home department to file review petition in Supreme Court to present the State’s side.

Notably, the Apex Court hearing the criminal case 416/2018 Justice Dr. Subhash Kashinath Mahajan vs. Maharashtra State Government and others had issued several guidelines under clause 83 on ST/SC (Prevention of Atrocities) Act 1989. Jharkhand is Scheduled Tribes / Scheduled Castes populated State and here under ST/SC (Prevention of Atrocities) Act instances of false implication could not often be found, said the CM.

In the recent order passed by it, the Supreme Court diluting the provisions of the Act, banned automatic arrests and registration of criminal cases.

The law was meant to protect the marginalised communities against discrimination and atrocities.
