Indore: HC dismisses petitions of Modern, Shubhdeep Colleges for conducting BEd exams


Indore: Indore bench of Madhya Pradesh High Court dismissed petitions filed by Modern College of Education and Shubhdeep College of Education seeking orders for Devi Ahilya Vishwavidyalaya (DAVV) for conducting BEd first semester exams for students of their campuses.

“The court did not find petitions filed by the two colleges maintainable,” said advocate Nimish Pathak, counsel of the DAVV. Modern College and Shubhdeep College were among BEd colleges which were not granted affiliation by DAVV for session 2017-18 following non-compliance of norms, including appointment of teachers under Code-28.

In absence of affiliation, students of the two college students were also denied BEd semester exams started on April 17. Against the university’s move, the colleges filed petitions in the High Court stating that they have complied with the norms so their students should be allowed to take exams.


The colleges furnished an old order by the court which stated that if they comply with the norms than university should grant affiliation to them. The university counsel argued that the previous order is not for permitting the two college students to take exam.

He stated that if the colleges have complied with the norms, the university could consider it for grant of affiliation and if it had not they are free to file contempt petition. After hearing both sides, the court rejected the petition on motion stating that it is not maintainable.
