Sindhuri to move HC, SC

IAS officer Rohini Sindhuri Dasari will move the High Court of Karnataka, challenging the CAT order on her petition, and also the Supreme Court with a contempt petition against the CAT for terming apex court’s order with regard to the transfer of civil servants ‘wrong’.

The advocate, representing the IAS officer, will file the petition challenging the CAT order in the High Court on Thursday. The contempt petition will be filed in the SC later this week.

When The Hindu contacted advocate H. Subramanya Jois, on Wednesday, he said that as it was a holiday on the day he had time to prepare the petition.

“Our contention is that the CAT has ignored the Supreme Court’s judgment in the Prakash Singh and Others Vs Union of India (2206), where it said the transfers of IAS officers should be done as per the recommendations of the board of civil services. The Supreme Court’s judgment is binding on all courts and tribunals. But the CAT has called the SC order wrong,” he said. Further, the advocate said the petition would be filed on Thursday and it might be taken up for hearing on Friday.
