Thane: Kin of traffic cop killed in road mishap gets Rs 32 lakh compensation

THANE: The Motor Accident Claims Tribunal (MACT) awarded Rs 32 lakhs compensation to the family members of a 47-year-old traffic police constable who was mowed down in a road accident in Kalyan in 2013.
The deceased, Rohidas Rathod, was attached to the Thane traffic division and was drawing a salary of Rs 31,972. The family members of Rathod moved the tribunal seeking compensation of Rs 63 lakh for the untimely death of the sole bread winner. The legal team appearing for the Rathod family told the tribunal that on July 17, 2013, the deceased was on his way to his office on a two-wheeler. When he reached the signal near Santoshi Mata Chowk, a dumper coming from Lal Chowkie jumped the signal and rammed into him. Rathod sustained severe injuries and succumbed to it later. An offence was registered against the dumper driver at the Mahatma Phule police station.

The counsel for the insurance company, in his submission, brought out the issues like uncertainities in life and future prospects which were rejected by the court.

After hearing both the sides, the judge, in his order, said,

“In the absence of any rebuttal evidence contention of the applicants which is corroborated by the police on record appears to be a trustworthy one. Therefore, I have no hesitation to come to conclusion that impugned accident occurred due to rash & negligent driving on the part of driver of dumper.” The court awarded a total compensation of Rs. 32 lakhs to the family and ordered that out of the realized amount the court ordered payment of Rs. 2.50 lakh each to the two children, Rs. 5 lakhs to his mother and Rs. 8 lakhs to his widowed wife.
