SHAHAJAHANPUR: Anxious at media reports about the UP government deciding to withdraw a case of rape and attempt to murder against former Union home minister
Swami Chinamayanand, the rape survivor, 39, has sent a video to President
Ram Nath Kovind, UP governor Ram Naik and Chief Justice of India Deepak Mishra seeking justice. In the video message sent on Tuesday, the woman, a resident of
Badaun, said, “BJP’s slogan is ‘Beti ke samman me,
BJP maidan me’, but the same party is taking an initiative to withdraw my case without even waiting for the court order. I have submitted an affidavit in the court seeking an arrest warrant against the accused.’’
The
rape case against Chinmiyanand was filed at Shahjahanpur Kotwali police station in 2011 and police had filed a chargesheet against him in 2012. However, he managed to get a stay on his arrest from the Allahabad high court, where the case is pending. “The state government cannot withdraw a case if it is pending in the high court. So Chinmiyanand withdrew his HC objection and thereafter the UP government initiated action to quash the case. The government is trying to abuse human rights of a woman,’’ she said.
The rape survivor, who has also sent a written complaint to the President, UP governor and CJI, added, “Chinmiyanand is a politically influential person and claims to be very close to UP chief minister
Yogi Adityanath. In fact, the CM visited his college in Shahjahanpur on February 25 and March 3 this year. Administrative officials in Shahjahanpur worship him like god.’’
Demanding transfer of the case out of UP, the woman said that she is a mother of a three-year-old girl and cannot go to Shahjahanpur for court hearings as she fears for her life. Meanwhile, her husband told TOI, “My wife is highly qualified and holds an MA, LLB and MEd degrees. However, she is forced to stay at home due to security concerns. She cannot pick up a job. Imagine the pressure that she has to go through every day. Everyone, including the government, is supporting Chinmiyanand. We have requested the honourable court to order his arrest. The next date of hearing is May 15 and we are hopeful that an arrest warrant will be issued against him.’’
