Tamil Nadu: Saidapet MLA Subramanian’s election upheld

CHENNAI: The Madras High Court has upheld the election of M Subramanian from the Saidapet Assembly constituency in May 2016.Justice P Kalaiyarasan upheld the election while dismissing a petition from an independent candidate S Parthiban, challenging the Subramanian’s election on various grounds, including corruption.Accepting the arguments of senior counsel P Wilson for Subramanian and rejecting the contentions of Parthiban’s counsel A Ilayaperumal, the judge observed that none of the allegations made in the election petition disclosed the cause of action. It is needless to say that the pleading about corrupt practice is vague and does not spell out as to how the election results were materially affected because of the factors mentioned in the petition. “Therefore, the election petition deserves to be rejected,” the judge said and accordingly dismissed it.
