BENGALURU: Noting that the
Central Administrative Tribunal (CAT) Bengaluru bench had not actually adjudicated the application filed by
Rohini Sindhuri Dasari, deputy commissioner of Hassan against her transfer, the
Karnataka high court on Tuesday asked the tribunal to consider her plea afresh.
Allowing the petition filed by Sindhuri , a division bench headed by chief Justice
Dinesh Maheshwari directed all the parties to the dispute to enter appearance before the tribunal on April 2.
The court has also specified that until final disposal of application filed by Sindhuri by the CAT, status quo, existing on the date of filing of the said application and as exists today, as regards to her posting should be maintained.
Rohini Sindhri had moved the high court challenging the March 21,2018 order passed by CAT wherein she was asked to submit a representation to Chief Secretary over transfer issue.
According to her, the order passed by CAT besides being cryptic and rhetoric also manifests that the tribunal has abdicated its judicial functions.
She had claimed that it was the chief secretary who had issued transfer order at the behest of chief minister and it is well-neigh impossible for her(Sindhuri) to conceive that in the event of her approaching the chief secretary any kind of justice would be done by the said officer.
