The High Court of Bombay at Goa has dismissed an appeal filed by Jayesh Naik of Cotta, Balli-Quepem, challenging his conviction by the sessions court, South Goa, for murdering his wife.
The sessions court has sentenced Jayesh to life imprisonment.
While dismissing the appeal, the High Court observed that the sessions judge had rightly concluded on the basis of the available evidence that the accused had caused incised wounds and stabbed the deceased in the stomach with the intention of causing her death and in view thereof, held that he had committed the offence of culpable homicide amounting to murder. The conclusions so drawn by the judge do not call for any interference as the accused has failed to create any doubt in the case of the prosecution. There is thus no scope to hold otherwise or to reverse the findings of guilt rendered by the judge against the accused.
The accused had in September 2014 committed the murder of his wife Vaishali alias Jiya Naik, at Cotta, Balli-Quepem, by inflicting multiple injuries by stabbing her in stomach and slitting her throat with a knife.
On the day of incidence, Naik returned home after dropping their two children to school and started quarrelling with his wife. He then locked the main doors and windows and assaulted her with knife.
Jayesh who used to work in a factory in Kuwait was jobless for a year and had been excessively consuming alcohol leading to frequent quarrels with his wife.
The public prosecutor, S R Rivankar had argued during the case that the action of the accused was pre-planned who had sent his children to school and thereafter committed the crime.
