HC notice to Uber in a case of assault by its cab driver

Alleged incident took place on November 13, 2017

The Karnataka High Court on Wednesday ordered issue of notices to M/s Uber India Technologies Pvt. Ltd. and its US-based parent company on a petition, which has sought action against the cab aggregator in connection with a case of assault by some drivers allegedly attached to Uber.

Justice Raghvendra S. Chauhan passed the order while hearing a petition filed by one Dave Banerjee, a city-based businessman.

The court also directed the State government and the Bengaluru city police commissioner to submit the English translation of the case diary of the First Information Report, registered on November 16, 2017 based on the petitioner's complaint, and explain the reasons why the police have not been able to take any concrete steps against the main accused.

The petitioner has pointed out that he booked a Uber cab through the aggregator's app around 9.30 p.m. on November 13, 2017 to travel from the international airport to his residence at Indiranagar.

It was alleged in the complaint that the petitioner and his friends were assaulted by Narasimha, a driver attached to Uber services, and other drivers attached to the aggregator at the Uber cab parking area.

The petitioner has complained that the assault was the result of inaction on the part of the Uber to ensure the safety of passengers as well as the State authorities in taking measure to prevent such incidents.
