The Chief Justice sought to know how the writ petition was filed on the next day on which the police complaint was filed

The Division Bench of the Kerala High Court stayed the registration of the criminal case against Major Arch Bishop Cardinal George Alenchery related to the controversial land deals of the Syro-Malabar Church.

A single judge of the Kerala High Court had ordered the police to register an FIR against the Cardinal and three others following a complaint.

While considering the case, the Chief Justice sought to know how the writ petition was filed on the next day on which the police complaint was filed. The Division Bench felt it was a case of abuse of process of law.

The counsel for the petitioner submitted that the city police commissioner had openly stated that the case would not be registered against the accused and hence approached the court next day.

The Bench stayed all proceedings in the case including the FIR filed by the police. The court posted the case for April 3.
