A Newark man found unconscious in a running car in the middle of an intersection, with a gun in his pants legs, was sentenced to 23 years in prison. 

Damien Roberts, 37, was given the prison term on March 9 by a Superior Court judge, the state Department of Justice announced Friday. 

Roberts, also known as Daymien Roberts, was found unresponsive in his car by police in November 2016. The car was running and in gear in the middle of the intersection of U.S. 40 and Brookmont Drive, said Nicole Magnusson of the state DOJ. 

Officers broke a window and when they ordered Roberts out of the car, they noticed the magazine of a gun tucked under his leg.

After police also discovered a .40-caliber gun in his pants leg, Roberts gave officers a fake name.

Roberts resisted arrest and fought detectives, injuring one, according to an earlier News Journal story. Police also seized an additional extended handgun magazine and prescription pills.

The gun in Roberts' possession was stolen, records show. 

Roberts had been prohibited from having a gun after previous weapon and robbery convictions, Magnusson said.

Court records show Roberts pleaded guilty to first-degree and second-degree robbery in 1998.

In January, Roberts pleaded guilty to the November 2016 charges of possession of a firearm by a person prohibited, carrying a concealed deadly weapon, identity theft and alcohol-related reckless driving. 

Last week a Superior Court judge sentenced Roberts to 23 years in prison on the weapon charges, Magnusson said.  

In addition to the 23 years, Roberts also was ordered to serve six months of either home confinement or work release, then 18 months of probation.
