A Burkburnett man is accused of trying to force himself on a teenage girl while she was trying to sleep at his residence.
Monty Allen Brown, 50, is charged with sexual assault – a second-degree felony. He remained in the Wichita County Jail Thursday afternoon in lieu of $100,000 bail.
According to the arrest warrant affidavit:
Burkburnett police were sent to a residence on Cottonwood Street around 1:53 p.m. on March 5 for a possible sexual assault.
The victim told responding officers she had been spending time at Brown's house when she started falling asleep on his couch. She said Brown was "forcing himself" on her when she woke up.
The victim said she ran to a nearby residence until law enforcement arrived within 15 to 20 minutes after the alleged assault.
She was taken to the Burkburnett Police Department to meet with detectives, who requested she get a sexual assault nurse's examination. Police also attempted to contact the victim's mother.
Detectives went to Brown's residence on North Avenue D and knocked on the front door several times while announcing their presence. After Brown didn't come to the door, the officers set up a perimeter nearby to see if he'd leave or return to the house.
A few minutes later, Brown left his residence and was walking quickly across the street when he was stopped by police.
Brown was speaking rapidly and in a paranoid state, and he could not stand still.
Detectives noticed a swollen spot on Brown's arm about two inches from his right wrist. Brown said it was a syringe mark from using methamphetamine about three days prior.
He denied knowing any reason the victim would say he had put his hands on her in any way and consented to buccal swabs.
Brown also allowed detectives to collect fingernail clippings from him, since the victim had told the nurse that Brown scratched her with his fingernails. Detectives also took, with Brown's permission, the clothing he was wearing at the time of the alleged assault.
On March 6, the victim was forensically interviewed at Patsy's House Child Advocacy Center.
The victim told the interviewer she had gotten to school late, and they would not let her in. So, she said she walked to Brown's house, saying he was "supposedly a family friend."
She said she met Brown once walking down the street and asked him for a cigarette. She said he later bought her a pack of cigarettes, so she's been going to him for them ever since.
The victim said she was tired on the day of the incident and told Brown she was going to go to sleep. When she laid down on the couch, the victim said Brown sat next to her and began touching her. She said she told him no several times.
After about 10 minutes of him being rough with her, the victim said she "just gave up."
Despite being told no several times, Brown continued to touch the victim inappropriately over and under her clothing.
Brown then forced himself on her. The victim said she tried to stop him, but there was nothing she could do because he was bigger than her.
The victim said she went to the bathroom to get dressed after he stopped. She then went into the living room, lit a cigarette and left his residence.
She told the interviewer she had to jump Brown's front fence because he locked the gate.
