
The apex court had sought details of all unencumbered assets in the previous hearing which the company failed to submit. The court then gave the company two more days to submit the details along with an affidavit.
A bench comprising of Chief Justice Dipak Misra, justices AM Khanwilkar and DY Chandrachud also imposed a cost of Rs 25 lakh on JM Financial Asset Reconstruction Company, which had shown interest in financing Unitech's under-construction projects in the previous hearing.
The bench observed that the JM Financial had given the impression that it would pay the money which can be used to refund the home buyers. However the company through its counsel informed that they are willing to finance the under-construction project.
"We treat it as an unnecessary diversion from the main case," the bench said. The fine imposed on JM Financial will be used to refund the homebuyers.
The case will now be heard on March 26.
