The ongoing trial in the case has fallen through with several witnesses turning hostile.
The Maharashtra government argued against the Supreme Court ordering a probe into the death of judge BH Loya, who was dealing with the Sohrabuddin Sheikh case saying it would ‘destroy the credibility’ of the judiciary forever.

“Is the judiciary in such a sad state that it dances to one man? Then we might as well wind it up,” senior advocate Harish Salve told a three-judge bench led by CJI Dipak Misra. Scurrilous allegations have been made against several judges, including a former CJI of the Madras high court in this context, he argued.

“Should the court order a probe the judges will be examined as co-conspirators in a murder. Are they conspirators in a murder?” “Is it conceivable that one politician is doing all these things? If the court were to order a probe, they will be questioned for murder. The system will be condemned forever.” BJP chief Amit Shah was an accused in the case. He was discharged by Loya’s successor.

The CBI is yet to file an appeal against the discharge. The ongoing trial in the case has fallen through with several witnesses turning hostile.
