After seven years in the case of illegal construction on parking space at Mansarowar complex at Habibganj, High Court ruled in the favour of petitioner that illegal construction was made over parking space of 4.5 metrEs and ordered to raze the illegal construction over Minimum Open Space (MOS) or deposit Rs 7.5 crore for construction of parking.
During the hearing of petition filed in the year 2011 by former BJP corporator and president of consumer and human rights protection society Satish Nayak. The issue was raised in the year 2009 and even question regarding the same was raised in the state assembly.
Court also said that BMC has granted permission for construction on MOS which was in violation of Town and Country Planning permission. It was found that the building developer was permitted to construct but it was built without leaving open space.
Earlier Minister of Urban Development and Housing Maya Singh issued orders to PS Malay Shrivastava to provide details under which rule the Town and Country Planning provided building permission and who were the responsible officials and action against them has been taken and reason if no action was taken.
The issue remained unresolved until Bhopal Municipal Corporation (BMC) Commissioner Chhavi Bhardwaj accepted reserved area for the open space and parking space was used for construction and creates parking issue.
