HC dismisses councillor’s plea

The Karnataka High Court on Wednesday dismissed a petition filed by K. Devadas, councillor of BTM Layout ward, and his wife Vasantha, former councillor of the same ward, questioning a notice issued by the crime branch of the city police asking them to appear in connection with a complaint lodged by a person related to an agreement to sell a piece of land.

An assistant commissioner of police, based on a complaint by M. Shantaraju, had summoned the petitioners.

The petitioners claimed that the complainant had unsuccessfully approached the civil court and is now attempting to misuse the police as the councillor is an aspirant to contest the ensuing elections to the Assembly.

The court termed that the petition as premature while observing that the petitioners will have legal remedy before an appropriate forum, including the State Police Complaints Authority, as and when cause of action arises.
