A Motor Accident Claims Tribunal has awarded a compensation of more than ₹44 lakh to a 60-year-old man whose left leg had to be amputated after being hit by a crane.
The vehicle had hit the victim from behind when he was walking on a service road in south-east Delhi’s Okhla last year. When the victim fell down, the crane ran over his left leg. He was working as a security guard and had a monthly salary of ₹20,500 at the time of the accident.
The Tribunal granted him the highest compensation of ₹13.87 lakh for an artificial limb.
The owner and the driver of the crane did not file any reply in the matter, while the insurance company with which the offending vehicle was insured, offered to settle the matter with a compensation of ₹1.05 lakh.
Holding the driver of the crane guilty of rash and negligent driving, Presiding Officer Raj Kumar Chauhan said: “The petitioner has proved that he suffered injuries due to rash and negligent driving of the driver... The petitioner is awarded a sum of ₹44,82,200”.
