Bail plea of Nalapad, 6 others reserved

The 62nd City Civil and Sessions Court reserved its order on a bail petition filed by Mohammed Nalapad Haris, prime accused in the assault on Vidwath. The court also reserved its orders on six other accused.

Judge Parameshwara Prasanna B reserved the judgement after hearing the bail petition and objections from the prosecution.

Mohammed, son of Congress MLA N A Haris, and six others were arrested for assaulting Vidwath L, son of an industrialist at Farzi Cafe in UB City on on February 17.

Senior advocate Tomy Sebastian representing Mohammed submitted that Vidwath is recovered from his injuries and able to give a statement. Mohammed's father is under tremendous pressure as elections are scheduled in March. The attack was not intentional but accidental. When the SPP mentioned that it may take eight months or eight years for Vidwath to recover from his injuries, Sebastian submitted that Mohammed cannot be denied bail.

Sebastian submitted two memos related to medico-legal case statements of the victim and also sought a serious investigation into the counter-complaint filed against Vidwath.

S Balan, the advocate who represented six other accused in the case, submitted that their names were neither mentioned in the complaint nor in the FIR. They were simply lodged in the prison. It was just a small incident and a fight between the group and there is no harm to the investigation by granting them a bail.

Special Public Prosecutor Shyamsunder M S who submitted medical documents on the condition of Vidwath in a sealed cover, submitted that the accused used a knuckle duster ring, a lethal weapon, to attack the victim and it was not at the spur of the moment and that they had a clear intention to attack the victim.

The victim was shifted from the ICU to the ward but it does not mean that he has completely recovered from injuries. He is still unable to give statements to police, the SPP stated.
