A Kerala girl, at the eye of a so-called love jihad storm, on Wednesday told the Supreme Court that her mother used to drug her food when she was in the 11-month custody of her Hindu parents after the Kerala HC quashed her marriage with her Muslim husband.

In an affidavit seeking permission to live with Shafin Jahan as his wife, as she had embraced Islam and married him as per own free will, Hadiya said she repeatedly complained to police regarding drugging of the food she took to break her fast during Ramzan but they did not take any action.

"It was my mother who used to prepare food for me for breaking my fast. One day at the time of breakfast, my mother went to the kitchen and tried to bring food for me. I came out from my room and proceeded to the kitchen in order to take food from my mother. She did not notice my presence. When I reached the kitchen, I saw my mother was doing something unusual with the food prepared for me and the same startled me," she said in her affidavit.

"I thereafter, informed the police about my mothers deed. But they were reluctant to hear me or to take any step to resolve the issue. On that day onwards, I began to prepare food for myself. The inaction of the police reminded me that the police would not question whatever crimes take place against me," she further added.

A bench, headed by Chief Justice Dipak Misra, which is hearing a petition filed by Shafin Jahan challenging the Kerala HC judgment which quashed their marriage will take up her affidavit for discussion on Thursday.

"I pray that this court may be pleased to pass appropriate orders to take action in accordance with law against all persons mentioned above, who tortured me horrendously and mercilessly. The baseless and malicious propaganda being made by the investigating agency and by the evil forces behind my father that I am not mentally sound, that I have connection with ISIS and the media trial on these allegations would detrimentally affect my future and career as a doctor, causing irreparable heavy injuries and loss to me," said the affidavit.

The release order was issued despite stiff objection by additional solicitor general Maninder Singh who appeared for the Centre and senior advocate Shyam Divan who represented her father who has the custody of the girl now after the HC quashed the marriage and gave her custody to him.

Both had argued that indoctrination and psychological influence are exceptions to consent but the bench said all these issues will be dealt with later.

"Once I realised that my parents used to mix drugs in my food, I started fasting, demanding to meet the SP for three days continuously, I gave up food," the affidavit said.

"Not even a drop of water I took. I told police that I have proof of mixing drugs in my food and that I would show it to the SP. On the third day, a deputy SP from special branch came to me and informed of the arrival of the SP within two days. But on or after the assured date, the SP did not come. I realised that the assurance given by the deputy SP is in vain. Again I started fasting. My health condition was deteriorating day by day." Hadiya's father Asokan KM, however, rubbished the allegation.
