Talwars' acquittal: 'Film director' judge moves Supreme Court, wants Allahabad HC remarks expunged

Special CBI judge Shyam Lal, who in 2013 had convicted Rajesh and Nupur Talwar in the 2008 Noida double murder case has moved the Supreme Court seeking modification in the Allahabad High Court judgement.

The trial court judge has sought expunging of 'personal remarks' made against him by the Allahabad High Court Justice Arvind Kumar Mishra -while pronouncing favourable verdict to the dentist duo in October last year.

Before ending his judgement, Justice Mishra in an acrimonious attack on CBI judge Lal read, " The judge tried to solve the Aarushi murder case like a mathematical puzzle when one solves a given question and then takes something for granted in order to solve that puzzle and question."

He added, "He surprisingly assumed fictional animation of the incident as to what actually took place inside and outside the Noida flat where Aarushi and Hemraj were found murdered, and like a film director... tried to thrust coherence amongst facts inalienably scattered here and there but not giving any coherence to the idea as to what in fact happened (sic)."

In a sharp worded attack, Justice Mishra added, "It appears that the trial judge was unaware of the solemn duty cast by the law as the judge has dealt with the entire case in style - a finesse."

The two-judge division bench of the Allahabad High Court had ruled that the CBI failed to provide evidence linking Rajesh and Nupur Talwar to the murders, eye-witnesses and could not establish a motive.

The bench therefore acquitted Talwars in the twin murder case of their daughter Aarushi Talwar and domestic help Hemraj over lack of evidence, adding that the couple should be given the benefit of doubt.
