'Nothing he said was real': Cass County ends probe into transgender inmate's complaint

William Anthony Fly, who now goes by "Toni," had complained to the Cass County Commission in a Dec. 29 letter that the county jail violated her rights by not housing her with females.

She also complained about a lack of appropriate medical treatment and inappropriate food.

Peterson, the commissioner with the law-enforcement portfolio, said he looked into Fly's claims with an open mind but found no merit in them. Fly, he said, is a "pot-stirrer," who likes to make trouble.

The jail has to balance protecting Fly from others and protecting others from Fly, Peterson said, referencing the inmate's crime. Court records show Fly, 49, pleaded guilty in federal court to transporting a female victim across state lines for criminal sexual acts.

Jail administrator Capt. Andrew Frobig, who kept Fly in a segregated unit that included other males, has said Fly showed willingness to have sex with females as a male and didn't want to house him with females as Fly wanted.

Medical professionals also didn't find merit in Fly's claims that she was fed food she has allergies to or that she didn't get the medical treatment she needed. The North Dakota Board of Nursing told Fly Jan. 26 that there was no evidence supporting her complaints.

Peterson asked commissioners if they wanted to place Fly's complaints on the agenda at the next commission meeting to take formal action but none took him up on it. He told The Forum afterwards that that's the end of it as far as he's concerned.

Fly, who has been moved by the U.S. Marshals Service to the McLean County Jail, is expected to return to Cass County for his April 20 sentencing.
