Hry notifies construction workers’ welfare rules

The Haryana Government has notified the Haryana Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Amendment Rules, 2018 with an aim to help the labourers engaged in construction works in the State.

As per the notified rules, the Haryana Building and Other Construction Workers Welfare Board may sanction an amount of Rs 3,000 per mensem (every month) as disability pension to a beneficiary who is permanently disabled due to paralysis, leprosy, cancer, tuberculosis and accident, said a spokesman of Labour Department.

In addition to the pension, he or she would be eligible for ex-gratia payment of Rs 1.50 lakh upto 50 per cent disability, Rs 2 lakh from 51 per cent to 75 per cent disability and Rs 3 lakh from 76 per cent and above percentage of disability.

The spokesman said that the Board may also sanction an amount of Rs 2 lakh to the dependents or nominee of a registered member towards financial assistance in case of death. If the death occurs due to accident during the course of employment at work place, the dependents or nominee of the registered member would be given Rs 5 lakh towards financial assistance.

He said that the Board may sanction financial assistance at the rate of minimum wage notified by the Labour Department from time to time as wage compensation to the beneficiary who is hospitalized due to illness caused by accident or any disease, beyond four days but upto a maximum period of 30 days in government hospitals or private empanelled hospitals.

The applications in the prescribed form would have to be submitted with such other documents as may be specified by the Board, he added.

The certificate from the employer or contractor that the applicant is a construction worker would be produced alongwith the application for registration.

In case such a certificate is not available, a certificate issued by Assistant Director, Industrial Safety and Health, Assistant Labour Commissioner or Labour Inspector, President or Vice President of the registered construction workers unions, District Development and Panchayats Officer among others would also be considered, the spokesman said.

He added that the new rules have been notified by amending Haryana Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules 2005.
