Police force continued to be deployed outside a land on which a dispute had arisen with regard to possession near Pushpa Mission Hospital on Wednesday. Meanwhile, the High Court stayed any action to demolish any part of the missionary hospital.
After violent incidents on Tuesday, the local administration invited both parties on Wednesday to resolve the matter. Member of Parliament (MP) Chintamani Malviya’s personal assistant Gagan Singh looked anguished over the attitude of revenue and police officials.
“It is crystal clear that the Diocese of Ujjain Roman Catholic Church does not have authority to possess unconstructed land and I am seeking possession of the same land. My supporters and I sought peace and cooperation from the missionary Hospital so that we could take possession, but this is what we got in return.
Moreover, the police registered cross FIRs under the same provisions of the IPC against us and the opponent party,” Dr Singh said that they would soon organise a ‘Sunderkaand’ at the spot and every responsibility of maintaining law and order would be that of the police and administration.
On the other hand, ADM GS Davar ordered the Ujjain SDM and Tehsildar to minutely go through the revenue records pertaining to ownership of land survey number 737/1/1 and then decide the case. He also ordered them to ensure that circumstances which occurred on January 30 should not reoccur in the future.
Meanwhile, Father Anthony on behalf of Diocese of Ujjain Roman Catholic Church filed a writ petition (2653/2018) at the Indore bench of the High Court.
The petitioner submitted that they were running a hospital and without taking recourse to the provisions of MP Land Revenue Code and there being any order of the competent authority merely on the basis of demarcation report, the emergency gate of the hospital had been closed. Justice PK Jaiswal ordered the respondents that till the next date of hearing (February 5) they would be restrained from demolishing any structure of the petitioner.
FIRs registered against both parties
A dispute over possession on land erupted between the office bearers of Catholic Church and representatives of MP Chintamani Malviya, Gagan Singh on Tuesday. The dispute turned violent and supporters of both the sides started pelting stones on each other and consequently four persons received injuries.
According to Father Antony the MP’s representative Gagan Singh and his supporters started taking possession the land adjacent to Pushpa Mission hospital forcibly while the matter is under consideration with Tehsildar of the area. Madhav Nagar police registered an FIR against Gagan Singh (29), Sonu Banjara, Dharmendra Panwar and others under Section 147, 336, 294 and 506 of the IPC on the complaint of Father Antony.
Simultaneously, on statement of Gagan Singh an FIR was also registered against Father Antony, PRO Antony, Father Joseph and Father Mangalam under Section 147, 336, 294 and 506 of the IPC.
