Teen won’t be charged for shooting death of boy, 15, during attack in Tacoma alley

A teenager who shot and killed an acquaintance after being attacked with a baseball bat will not be charged with the death because it was self-defense, according to the Pierce County Prosecutor’s Office.

The 15-year-old remains in custody at Remann Hall Juvenile Detention Center. He pleaded not guilty Wednesday to second-degree unlawful possession of a firearm.

Prosecutors decided not to charge the teen with 15-year-old Hector Gonzalez’s death because Gonzalez and his best friend allegedly lured the teen into a Tacoma alley early Saturday and jumped him.

The plan was to rob the teen of his marijuana and gun.

After being whacked several times with a baseball bat, the teen allegedly fired a single shot, hitting Gonzalez in the chest.

Gonzalez died at the scene, moments after police arrived.

His best friend, also 15, was found in the alley when officers responded. Although he initially denied knowing Gonzalez or what prompted the shooting, he eventually admitted to planning the robbery.

He and his 15-year-old girlfriend are charged with attempted first-degree robbery and second-degree assault.

They pleaded not guilty Tuesday and remain in custody.

Police have not yet recovered the gun used in the shooting, which the teen who was jumped said he found days earlier and decided to keep for protection.

He told detectives he threw it in the bushes as he ran away from the scene.

The girl asked the teen to come to her home early Saturday, and the teen agreed because he was hoping to have sex with her, according to charging papers.

When he arrived, the gun fell out of his pocket and she asked him to leave. But first, she texted her boyfriend and Gonzalez to warn them the teen had a gun, records show.

They texted back that “they would take care of it,” records show.

The teen walked outside and was immediately hit in the head with a baseball bat.

Neighbors in the 5100 block of South Oakes Street reported hearing male voices arguing for a few minutes before a gunshot rang out.

“Police noted that the respondent had sustained injuries consistent with defending himself from an attack with a baseball bat,” records show.
