A lawsuit against the South Burlington School District over the high school's mascot name change is heading to the Vermont Supreme Court.

A judge on Tuesday granted the school district's appeal of his earlier decision to deny the district's request to dismiss the lawsuit. The Burlington Free Press reports the group of South Burlington residents alleged in their lawsuit that the School Board was legally required to consider a petition to take the high school's team name to a citywide vote.

Last February, the school board voted unanimously to drop the "Rebel" school nickname because of connections to the Confederacy. Students later chose to adopt "Wolves" as the new mascot name.

Some alumni and parents argued the board should have waited for a public vote before the name change.
