MANATEE COUNTY — Four Manatee County teenagers have been charged with sexual battery for allegedly having sex with a 13-year-old girl in August 2017, according to a Manatee County Sheriff’s Office report.

The Sheriff’s Office arrested Timothy Hinds, 18, Joshua Calloway, 16, Isaiah Gallardo, 17, and Shamar Mobley, 15, on Jan. 19. All were charged as adults.

The Herald-Tribune does not ordinarily name defendants under 18 but is doing so because of the nature of the felony charges and because all are being charged as adults.

Deputies are looking for a fifth suspect, who is 17.

According to the arrest report:

The five teenagers, who were all under 18 at the time of the incident, met the victim at a house on 31st Circle East in Bradenton. She had sneaked out of her house to meet up with one of the teenagers, identified by the Sheriff’s Office as Calloway, then 15, to watch Netflix. They met and walked to the home, which was an apartment.

Once they reached the apartment and walked inside, Calloway allegedly led the victim to a bedroom and shut the door. They watched television for 20 to 30 minutes, before four other teenage boys arrived at the apartment. They all attend Braden River High School, according to the Sheriff’s Office.

Calloway began arguing with the other teenagers almost immediately and the victim stated she overheard them talking about her age and “being a virgin.”

Calloway went back to the room and shut the door, the report said. He asked the 13-year-old girl to undress, which she declined. He then allegedly had sex with the victim, who said she was afraid of Calloway and thought she would be hurt if she resisted, the report said.

After the assault, Gallardo, then 16, entered the room and began arguing with Calloway and they left the room.

One by one, the other four teenagers, first an unnamed 16-year-old, followed by Gallardo, Hinds, then 17, and Mobley, then 14, returned to the room and allegedly had sex with the girl. The unnamed teenager has not yet been located.

The victim explained to detectives that she was in fear for her safety because of the number of suspects and past knowledge of Calloway’s actions. She told detectives she was crying throughout the last three encounters.

The girl did not reveal the episode until Jan. 18, when she was interviewed by a children’s services counselor at Braden River High School.

A deputy was sent to to Braden River High School, where they questioned Gallardo after receiving permission from his mother. The deputy also questioned Hinds, who originally denied the allegations, but then made statements that he had consensual sex with the victim.

Hinds allegedly said that the four other teenagers also had sex with the victim that night.

Calloway, Gallardo, Hinds and Mobley are being held at a juvenile booking facility, according to Sheriff’s Office spokesman Dave Bristow.

A neighbor who lives near the neighborhood where the incident took place on 31st Circle said his children, a boy and a girl, ages 8 and 12, may have seen the suspects playing in the neighborhood.

He called the suspects’ actions “stunning.”

“My kids trick or treat in this neighborhood. We consider it a safe neighborhood,” Serge Pericozzi said. “My daughter is 8, and if somebody did this to my daughter I’d be in jail — there’s no doubt about it.”
