Sohrabuddin case: CBI to oppose PIL over Shah’s discharge

The Central Bureau of Investigation (CBI) said on Tuesday that it would oppose the public interest litigation (PIL) filed in the Bombay High court by the Bombay Lawyers’ Association (BCA) challenging the special court’s order discharging BJP national president Amit Shah in the Sohrabuddin Shaikh alleged fake encounter case.

During the hearing a PIL filed by Bombay Lawyers’ Association that termed as “illegal, arbitrary and mala fide” the CBI’s act of not challenging the Special Court’s December 30, 2014 order discharging Shah in the

alleged Sohrabuddin Shaikh fake encounter case,  the CBI sought time to file a reply on the petition.   

After hearing both sides, a HC division bench of Justices SC Dharmadhikari and Bharti Dangre posted the PIL for arguments on February 13.

Earlier, CBI counsel Anil Singh informed the High Court, “We are opposing the petition. We also have an issue on the maintainability of the petition. The discharge order is of December 2014...There is an issue of limitations”.
