The supreme court on Monday said that it would look at the records regarding the death of Judge B H Loya in view of the controversy in the press regarding his death.
Justice Loya allegedly died after a massive heart attack. But there have been reports in the media pointing out inconsistencies in the factual scenario surrounding the death.
A three judge bench led by Chief Justice of India Dipak Misra today dubbed the case serious and said it would look at all the records in the case.
"Let it never be on our conscience that we didn't look at what we should have," Justice D Y Chandrachud said. "We must look at facts."
Justice Loya was dealing with a case against BJP chief Amit Shah. His brother and sister had demanded a probe into his death. His son though said he did not want a probe.
The top court withdrew all the cases regarding loya to itself and sought the original records in the case. Maharashtra will produce the records. The court will deal with the case on February 6.
