Beauty Blunder Update: Microblading Law To Be Tweaked

We have an update on a KELOLAND News investigation we first brought you at about this time last year.

Our investigation  "Beauty Blunder" found that the latest trend in permanent makeup had little protection or oversight for consumers in South Dakota.

A year after KELOLAND Investigates showed you botched eyebrows from microblading and discovered that there was no one regulating the procedure in South Dakota, the state legislature is taking up the matter.  

The Department of Health is asking lawmakers to include microblading under tattooing and body piercing laws used by cities who chose to regulate such procedures.

"Tattoo rules will need to be reviewed and revised to include microblading, should this law go into effect," Winter said.

No one appeared in opposition, however, Pierre Cosmetologist Kade Herbert did take issue with microblading being put under the same category as tattooing.

"I do believe that regulation of microblading is needed. My only concern with SB30 is that microblading is being inserted into a statue that defines tattoos as permanent marks,' Herbert said.

That's the same issue we found in our investigation--the state health department at the time told us microblading couldn't be regulated like tattoos because it only lasts 12-18 months.

However, the South Dakota Board of Medicine says  microblading is tattooing and should be considered so under the law. 

The committee asked Herbert to explain how microblading is done. A member of the committee said, "Perhaps a demonstration on the senator would be....” (Laughter breaks out among committee members.)    

"I brought tools," Herbert said.

In the end, the committee asked the Health Department to meet with Herbert to clarify the language in the bill to reflect that microblading is semi-permanent. 

The Health Department will make any needed changes and bring the bill back to the committee.  Coming up on Inside KELOLAND this Sunday night we'll hear from those in the industry who are eager to see better laws regulating microblading because they've seen a fair share of botched brows.
