The Sanjay Orthopedic, Spine and Maternity Centre, has claimed that the Medical Council of India (MCI) has given clean chit to it in an alleged case of negligence in the treatment of an accident victim.
In a press release, the centre has said that the MCI has failed to find any professional misconduct on part of Dr BKS Sanjay and has set aside order of Uttarakhand medical Council (UMC).
Acting on the complaint of one Dr MML Ahulwalia in which he had alleged gross negligence in the treatment of his son who died during treatment, the ethics committee of the UMC had debarred Dr Sanjay to practice for six months.
The complainant had alleged that the death of patient was not informed to the police nor was the post mortem of the accident victim done. This victim was brought to the nursing home by 108 ambulance service. On the complaint by the relatives of the deceased the investigation by UMC found negligence in treatment.
The hospital said that Dr Sanjay appealed to MCI, New Delhi against Uttarakhand Medical Council impugned order on August 9, 2017. The above matter was considered by the Ethics Committee of the MCI at its last meeting held on November 20 and 21, 2017 did not found Dr BKS Sanjay guilty of any misconduct/medical negligence and exonerated him. The committee observed “In view of above the Ethics Committee is of the considered opinion that no case of medical negligence or misconduct is made out against appellant and accordingly the appellant Dr. B.K.S. Sanjay is exonerated and the order dated 03.08.2017 passed by the Uttarakhand Medical Council is hereby set aside”.
The recommendations of the ethics committee were approved by the executive committee of the MCI at its meeting held on December 14, 2017 and further by oversight committee vice their letter dated January 3, 2018.
