Mumbai: A criminal writ petition has been filed in the Bombay High Court seeking directions to the Central Bureau of Investigations (CBI) to probe the fire incident which took place in two restaurants, situated in Kamala Mills Compound, Lower Parel. The petition also seeks booking of officials of the BMC as well as the owners of the Mojo Bristo and 1 Above restaurants under the charges of culpable homicide not amounting to murder.

The petition has been filed by Pratik Thakur, his wife Toral Thakur and five of their relatives, including two American citizens. According to the petition, Thakur along with his wife and their relatives had been to the 1Above restaurant on an unfortunate night, as they all had planned a small get together.

The petition states, “The staff of 1Above though aware of the fire took place in Mojo restaurant, they did not inform or alarmed the guests, patrons in their hotel. We all have received burn injuries due to the massive fire. The staff of 1Above hotel ran away from the premises without helping or rescuing the customers sitting in their restaurant and bar.”

The petition highlights the ‘common’ exit and entry point of both the restaurants, which was hardly 2 feet wide. The petition also mentions the absence of fire exits in both the restaurants and also the lack of fire safety equipment, because of which the tools were not used or operated to douse the fire. Accordingly, the Thakur’s have sought to book the owners of both the restaurants.
