PIL asking for probe in Judge Loya's death to be heard by Bombay High Court on Jan 23

The Bombay High Court will hear a petition asking for an investigation of Judge Loya's death, on January 23.

The PIL, filed by the Bombay Lawyers' Association, asks that a Commission of Enquiry headed by retired Supreme Court judge be constituted to investigate the events and circumstances surrounding the death of Judge BH Loya, who was hearing the alleged Sohrabuddin fake encounter case.

In November, a magazine had raised questions about Loya's death after speaking to his family members in Maharashtra.

The petition says that the news "sent shock waves in the entire country, particularly, in the legal fraternity including advocates and judges as well."

"In spite of that therein is pernicious silence from all authorities on this issue which has created serious doubt in the mind of the public at large about safety and security of judges ensuring independence of judiciary," the petition read.
