Tempo driver gets 2 years in jail in accident case

A Delhi court has dismissed an appeal by a tempo driver against his two years’ imprisonment for hitting a mother-daughter duo at a road divider and killing the daughter on the spot.

Holding the driver guilty of driving the vehicle in a rash and negligent manner, a Metropolitan Magistrate court had convicted him and awarded the sentence

The duo was standing at a road divider when the vehicle hit them. The mother was the only eye-witness to the accident.

In her deposition, the mother stated that they had crossed the road and were standing on the divider when a vehicle travelling at high speed hit them. The mother said that she fell to the ground and lost consciousness.

She had also identified the driver of the offending vehicle at the police post.

‘Was not driving tempo’

In the appeal, the driver said he was not driving the vehicle as he had gone to his village to take care of his expecting wife. However, the owner of the vehicle confirmed that it was the convict who was driving the offending vehicle.

“The photographs on record corroborate the case of the prosecution,” Special Judge Savita Rao said.

“Another aggravating circumstance (against the driver) is the conduct of the appellant who instead of trying to help the victims, ran away from the spot... Judgement of conviction dated 08.09.2017 and order of sentence dated 23.09.2017, passed by the trial court are upheld,” added the Judge.
