DHAKA: The Appellate Division of the Supreme Court on Tuesday (January 9) has allowed the executive magistrates to run the mobile courts until disposal of the leave to appeal that challenged an HC order.
A five-member bench of the Appellate Division headed by Acting Chief Justice Abdul Wahhab Mia issued the order that fixed Tuesday (January 16) as the next hearing date.
Earlier, the state filed a leave to appeal against a High Court order that declared the mobile courts illegal.
On Tuesday, Attorney General Mahbubey Alam and Deputy Attorney General Motahar Hossain Saju moved for the state while Lawyer Hassan MS Azim moved for the writ petitioner.
Quoting Attorney General Mahbubey Alam, Hassan MS Azim said that that the appeal hearing has been adjourned as state side lawyer Barrister Amir-Ul Islam is now in abroad.
The mobile courts will be led by executive magistrates till disposal of the appeal while the court will continue its observation.
On May 11, the HC bench of Justice Mainul Islam Chowdhury and Justice Ashish Ranjan Das issued the verdict against the operation of mobile courts after hearing of a rule in this regard.
On May 14, SC stayed the High Court verdict following an appeal plea filed by the government. The stay order was extended in several phases afterwards.
