THANE: The special MCOCA court on Monday rejected
Iqbal Kaskar's plea to allow him to savour
home food on the grounds that he is a patient of blood pressure and also a diabetic.
Kaskar, arrested in an extortion racket, is the younger brother of gangster
Dawood Ibrahim and is lodged in the Thane central jail. Special MCOCA judge AS Bhaisare observed the doctor treating Kaskar had not prescribed any special diet to the accused so there was no question of granting his request of home food.
Kaskar in his application claimed that due to his ailments, home cooked food is advisable to keep him healthy. He also submitted that previously, when he was in custody in earlier case at Mumbai, Central Prison in 2003 to 2007, he was provided with the facility of home food and has never misused the liberty granted to him.
The prosecution, however, vehemently objected the plea and pointed out that the edible food is provided in the jail, besides there are other facilities like canteen and bakery foods which are available inside. The prosecutor said they have visited the jail premises and tasted the food during inspection.
After hearing both the prosecution and defence, the judge in his order pointed, " At the most, attempt to reduce the gravity of choice of food of individual can be made," the judge pointed out in the order.
Also, accused nowhere stated about the quality of the food. On the contrary, as per advise of medical officer prisoners are provided with milk, eggs considering his health health problems, the judge said. Moreover, Kaskar said he is suffering from diabetes, blood pressure and giddiness and is undergoing treatment and doctors have prescribed medicine but had not prescribed any special diet and has not made out any special ground to grant his application.
