The District Sessions Court on Wednesday extended Ryan International School murder accused's custody at the observation home until January 17.
The Central Bureau of Investigation (CBI) had arrested him on November 7 in connection with the murder of seven-year-old Pradyuman Thakur inside the school washroom. The final hearing of his bail plea is scheduled for January 6. The court also decided that petition filed by juvenile with regard to police custody and fingerprints would be heard on the same day.
Earlier the CBI had opposed the bail plea of the accused. The CBI submitted to the court that the investigation in the case was pending and the accused could influence the witnesses and could also abscond, thus hampering the investigation.
"The boy was produced before the Additional District & Sessions Judge because his custody ended on Wednesday and no arguments were pit forward during the hearing. The final arguments on the matter will take place on Saturday," Sandeep Aneja, "the accused's lawyer, said.
Aneja had earlier submitted a plea that under section 10(5) of the JJ act model rules-2016 to seek his release on bail. "The CBI should have completed investigation within 30 days, and as it has not done it the bail should be automatic," he said.
The Juvenile Justice Board had on December 20 ruled that the 16 and half year-old boy would be tried as an adult. The Juvenile court had noted that he was mature enough to recognise the consequences of his actions.
The report cited instances to establish that the accused had a hyper-aggressive streak to his personality and this also indicated that the teenager should be treated as an adult.
