SAN ANTONIO (AP) — Police in San Antonio have taken the unusual step of using a state charge to arrest a man suspected of smuggling 12 people into the country rather than refer the case to federal immigration authorities.

Fifty-eight-year-old Herbert Alan Nichols of Houston was arrested Dec. 23 and charged with a felony count of smuggling persons. He was no longer behind held Thursday at the Bexar County jail.
