Solar Scam: Saritha Nair Questions First Conviction At High Court

Solar scam accused Saritha S Nair has approached the Kerala high court challenging her first conviction in the cheating cases registered across the state.

Saritha was found guilty of cheating as well as for criminal breach of trust and forgery and sentenced to undergo rigorous imprisonment for three years by a magistrate court in the case registered at Aranmula police station. The case was registered on the basis of a complaint filed by an NRI alleging that he was cheated of Rs1.17 crore.

Questioning her conviction in the cheating case, Saritha has contended before the high court that it is not a legal conviction but a moral conviction. Prosecution had miserably failed to prove the offences alleged against her, her petition said.

She was convicted for cheating by impersonation (section 419 of Indian Penal Code) by the trial court even though prosecution had no case that she had impersonated anybody, Saritha argues. No evidence was adduced by prosecution to establish that Lakshmi Nair (name allegedly used by Saritha for cheating) and Saritha S Nair are different, she pointed out. Read More…
