A man who was convicted of sexually assaulting a minor in 2001 is still being monitored by authorities -- and is accused of cutting off his ankle monitoring bracelet recently.
Gregory Davis, 36, is on community supervision for life (CSL) for the 2001 crime, in which the victim was less than 13-years-old. He served five years of a seven year prison sentence and started CSL in 2006.
Davis is accused of making two Facebook accounts, leaving the state without permission and cutting off his monitoring bracelet. He appeared in court Thursday, and a judge released him on different monitoring conditions.
On Dec. 12, a parole officer went to Davis' Trenton residence for a home visit inspection, prosecutors said Thursday.
The officer saw Davis in the front window of the home but he did not answer the door. The officer then went to the back of the house where he found Davis' monitoring bracelet in the backyard.
"I am having a lot of trouble with what I am supposed to do," Mercer County Superior Court Judge Ronald Susswein said at the hearing.
Davis' defense attorney Laura Yeade argued that her client had been following all of CSL's guidelines up to this point - for the past ten years. She said that in August, Davis was assigned a new probation officer, and the two have not been getting along.
"When you cut off am ankle bracelet that is the ultimate thumbing your nose at authority," Susswein said.
The judge agreed to release Davis on level-three monitoring. Susswein told Davis he would give him one chance, and that he'd been very close to being jailed.
