Maharashtra govt set to form RERA tribunal by February

Mumbai: The state government has planned to form RERA (Real Estate regulatory Authority) appellate tribunal by the month of February. This tribunal will help the builders and buyers to approach it in case they are willing to file complaints against the RERA rulings. Till date, the complaints related to RERA orders were dragged in court which made it difficult for the home buyers.

The government was yet to form a tribunal even nineteen months after the RERA Act was implemented in Maharashtra in May 2016. Several RERA orders have been challenged in the Bombay high court in the absence of a tribunal which becomes expensive and inconveniences the home buyers. “The citizens will be able to approach the tribunal from next year onwards in order to get their issues redressed,” said a RERA official.

In November, a consumer body called Mumbai Grahak Panchayat (MGP) had approached Chief Minister Devendra Fadnavis and asked him expedite the process of forming a tribunal. Sources in MGP said the delay in forming a tribunal was causing bringing unnecessary hurdles to the citizens. Several appeals were in queue and many moved to high court in absence of a tribunal. The formation of the tribunal is compulsory as per section 49 (1) of the RERA Act.
