Ryan murder case: CBI opposes accused’s bail plea

The CBI on Friday opposed the bail plea of the 16-year-old student, accused of killing a seven-year-old boy, of the Ryan International school.

The Additional District and Sessions Judge Jasbir Singh Kunduy heard the bail petition of the accused in Ryan murder case and reserved the order for hearing on December 6.

The court also decided that petition filed by juvenile with regard to police custody and fingerprints would be heard on the same day.

The court also extended the custody of the teenager until January 3. It was the first appearance of the Juvenile accused before the SessionsCcourt in Gurugram.

While opposing the bail plea of the juvenile accused killing a seven-year-old Pradyuman Thakur of Ryan International School, Bhondsi campus, the CBI submitted before the court that the investigation in the case was pending and the accused could influence the witnesses and he could also abscond thus hampering the investigation.

CBI also stated that the contention of the petitioner that the investigation should have been completed in 30 days was wrong as this rule was applicable to child welfare police and not to the central agency.

Earlier, the juvenile's lawyer contended that under section 10(5) of the JJ act the CBI should have completed investigation within 30 days, and as it has not done it the bail should be automatic.

The Juvenile Justice Board (JJB) had on December 20 ruled that the 16-year-old boy would be tried as an adult and directed that he be produced before the Gurugram sessions court on Friday.

The Juvenile court had noted that he was mature enough to recognise the consequences of his actions. The report cited instances to establish that the accused had a hyper-aggressive streak to his personality and this also indicated that the teenager should be treated as an adult.

"Along with the bail appeal, we have moved another plea related to the custody of the juvenile and opposed CBBI to seek his fingerprint impressions. We urged the court that the CBI didn't file their charge sheet within the one month period soon after arresting the juvenile and it was mandatory as per the Juvenile Justice act but the agency replied that the one month conditions is not applicable on them the argument on the matter will take place on January 6," Sandeep Aneja, the juvenile's lawyer, said.
