She said that he had ulterior motive to release the video a day ahead of the RK Nagar by-election, in a bid to influence the voters in the constituency. However, Vetrivel's lawyer stated that he was innocent and he had no ulterior motive for releasing the video. "He released the video for the benefit of the people and party cadres," the counsel said.
Accepting the arguments of the public prosecutor, the judge dismissed Vetrivel's plea. Sources said that the police would now take action against him based on complaints filed by the Election Commission and the inquiry commission probing the death of Jayalalithaa.
RK Nagar returning officer Pravin Nair said in his complaint to the police that, "no person shall display to the public any election matter by means of cinematography, television or other similar apparatus in any polling area during the period of 48 hours ending with the hour fixed for the conclusion of the poll for any election in that polling area."
Alleging that the release of the video was a violation of model of conduct, he urged the police to take action against him.
In his complaint, N Panneerselvam, secretary to the probe commission set up by the Tamil Nadu government to investigate the hospitalisation and death of Jayalalithaa, stated that the video was a violation of the commission of inquiry acts and rules. Stating that the video released was an act of defaming the commission, he said, "notification summons had been issued to appropriate persons and the trial had commenced on November 22."
