E300 000 MISTAKE OPENS CAN OF WORMS

MBABANE – The erroneous transfer of E300 000 into a bank account of a man from Ndlunganye was a blessing in disguise.


This is so because it has since been discovered that the money was meant to pay three siblings who had allegedly sold a homestead of their late father, Christopher Mavimbela, without the knowledge of the other beneficiaries.


Christopher had 14 children.
The homestead, which is situated at Logoba in Matsapha, consists of a double-storey building and 19 flats.
The three siblings, who are alleged to have sold the homestead and the flats are Melusi Mavimbela, Buyisile and Temakholo, all Mavimbela.


The executor of the businessman’s estate, Happy Colisile Mavimbela who is also one of the deceased’s daughters has since taken the trio, and Gege Member of Parliament (MP) Mbongiseni Malinga and Bongiwe Grace Simelane to court. Malinga and Simelane are said to be the buyers of the properties in dispute.


The executor’s lawyer, Nkosingivile Dlamini from Robinson Bertram, yesterday moved an urgent application at the High Court.
Happy, among other prayers, seeking an order interdicting and restraining the trio from selling the homestead.
 The executor also wants the court to stop the legislator and Simelane from collecting rentals from the houses built at the homestead of the late businessman. 


She is further praying for an order directing the tenants to pay their rentals to the estate of the late businessman pending finalisation of the matter. The MP and Simelane, as alleged purchasers, have been cited as respondents in the matter.
Giving a background of the matter, Happy stated that on or about April 11, 1999, the businessman passed on and she (Happy) was duly appointed executor of his Estate on August 1, 2000.
