‘Police only relying on Boy’s statement’ in desecration case objected

COLVA: The prosecution has objected to the application moved before the judicial magistrate first class to drop charges of desecration against Francisco 'Boy' Pereira.


Pereira, through his advocate under the legal aid scheme, has filed the application in connection with the alleged charges of desecration of a cross belonging to Irinea Fernandes from Calconda in Margao on July 14.


The application stated that there was no evidence on record to frame charges under Section 295 IPC as there is not a single eye witness and that the police are relying on the statement of the accused.


In its reply on December 15, the prosecution submitted that at this stage, it is yet to be determined whether there is a prima facie case against the accused and that such meticulous consideration is not warranted. The case has been adjourned for December 22 for orders from the court.
