GURUGRAM: The Juvenile Justice Board (JJB), Gurgaon, on Wednesday allowed CBI to take fingerprints of the Class 11 student, who was apprehended last month in connection with the murder of Pradhyumn Thakur of Ryan International School-Bhondsi.
The agency is likely to take the fingerprints at the observation home, Faridabad, where the juvenile is lodged, on December 19, as the board rejected the application filed by the juvenile's counsel opposing the move.
Judicial Magistrate (First Class) Devender Singh scheduled the next hearing for Friday (December 15), when the board will hear arguments on the bail application of the Class 11 student. The board will also open reports of a psychological assessment and a social background test on Friday, before taking a call on whether to treat the student as an adult or minor.
Sandeep Aneja, the juvenile's counsel, said they had filed a bail application before the board on Tuesday. "The board has issued notice to CBI, seeking its reply, and scheduled the next hearing for December 15," he added.
Aneja further said as per the Juvenile Justice Act, the central agency had to complete the investigation and file its report within one month of the date of apprehending the student. He was apprehended on November 7 and produced before the board on November 8. More than one month has passed but the agency has not filed its report yet. "Before the board, the agency claimed to have completed the investigation with the juvenile. So, he should be given bail," he argued.
The board also rejected four other applications filed by the juvenile's counsel in past few weeks.
Aneja had pleaded that the hearing be postponed on the application of Pradhyumn's father Barun Thakur for treating the Class 11 student as an adult. In his application, Aneja had argued that the board should not rush to decide on the trial as the investigation had yet not been completed. But the board rejected it.
The lawyer had also sought copies of the reports submitted by the experts' team on the student's psychological assessment. But the board observed that the reports, which have been submitted in the sealed covers, would be opened in the board on December 15, when the juvenile's counsel and parents can see it inside the board. But, they will not get any copy.
These apart, CBI had asked his parents to submit copies of the student's date of birth and school passing certificates. Challenging it, the parents had filed an application, saying they would prefer to submit the documents before the board. This application too was rejected.
Aneja had also filed an application, alleging that CBI was revealing the identity of the juvenile, but the board dismissed it.
Besides, his parents withdrew an application, in which they had alleged that CBI had violated the time restriction imposed by the board on questioning of the student, during the police remand between November 8 and November 11. As per the board's directive, CBI could question the juvenile between 10am and 6pm, but the parents had alleged that the agency continued investigation even after 6pm.
Class 2 student Pradhyumn was found bleeding inside a washroom on the Ryan's Bhondsi campus and later succumbed to injuries on September 8. The Gurgaon police had arrested a bus conductor as prime accused and made the Class 11 student a witness.
Later, on the demand of Pradhyumn's family, the investigation was handed over to CBI on September 22. CBI found no incriminating evidence against Kumar and apprehended the Class 11 student as the prime suspect in the case.
