Dismisses appeal of accused that victim ‘improved’ testimony

A Delhi court has upheld the conviction and simple imprisonment of three accused persons in a dowry harassment case.

Additional Sessions Judge Sukhvinder Kaur dismissed their contentions that there was a delay of about two years in lodging a FIR and the victim and her brother had made ‘improvements’ in their testimonies.

According to the complaint lodged by the victim’s father in 1991, the woman’s husband, his brother and the latter’s wife subjected his daughter to cruelty while demanding dowry.

Dismissing the argument by the counsel for the convicts that there was an unexplained delay of about two years in lodging the FIR, Ms. Kaur said: “The victim in her testimony has explained that even after the delivery of a child, they had tried their best to reconcile the matter with her in-laws but they did not pay any heed to it and remained adamant in their attitude.”

On their argument about ‘improvements’ being made by the two prosecution witnesses in their evidence, the court said: “The credibility of witnesses cannot be impeached only by confronting their evidence in the court with their previous statement recorded under Section 161 Cr.PC.”

Dismissing the appeal by the three accused, the court upheld the Metropolitan Magistrate court judgement.
